Abstract

This study focuses on highlighting the differences in Usul (Islamic legal theory) within the field of Qiyas (analogical reasoning) through the book 'Minhaj al-Wusul' by Judge al-Baydawi - may God have mercy on him. It provides a theoretical analysis of the definitions and basic concepts of the Usuli terms related to Qiyas, then clarifies the similarities and differences between them, leading to the impact of these differences. The research emphasizes the importance of distinguishing between terms in Usuli and fiqh studies. The researchers used inductive, analytical, and comparative methods. They relied on the Minhaj al-Wusul by Judge al-Baydawi, its commentaries, and other Usul and fiqh books from various schools and modern sources to show how these Usul differences affect resolving conflicts in rulings and in applied juristic matters. The study concluded that although the Usuli terms in the discussion of Qiyas rulings may appear similar on the surface, they have differences in reality and help in grounding concepts and terms for resolving conflicts or in practice. The findings confirm that understanding these Usuli differences is essential for any Usuli researcher and contributes to establishing a scientific methodology in deriving Islamic rulings.
