Abstract

This study aimed to clarify the criminal liability for disrupting the marital bond according to Jordanian and comparative legislation. The descriptive-analytical and comparative methods were employed. The study is divided into two chapters. The first chapter addresses the nature of the marital bond through the first section: the concept of disrupting the marital bond, and the second section: the legal basis for the crime of disrupting the marital bond. The second chapter addresses the legal model of the crime of disrupting the marital bond through the first section: the elements of the crime of disrupting the marital bond, and the second section: criminal complicity in the crime of disrupting the marital bond. Among the findings: the Jordanian legislator stands out from comparative legislations by dedicating Article 304/3 of the Penal Code to punishing the act of disrupting the marital bond, unlike the Egyptian legislator, whose legislation addresses a different type of crime unrelated to disrupting the marital bond. The study recommends dedicating a separate article specifically to the crime of disrupting the marital bond, rather than including it in the third paragraph of Article 304 of the Penal Code, as the first and second paragraphs of this article already address this issue. This is a crime entirely separate from this one.
